General Terms and Conditions for Customers
These General Terms and Conditions (“Terms”) describe the key rules that apply when you purchase products or services from BOND47 and its divisions in aviation, maritime, and electronics. They are intended to ensure clarity, transparency, and a fair business relationship between BOND47 (“we”, “us”, “our”) and each customer (“you”, “your”). By placing an order, signing a quotation or contract, or using our services, you agree that these Terms form part of our agreement, in addition to any specific commercial terms that may be agreed in writing.
Scope of supply and orders
Unless otherwise agreed, these Terms apply to all offers, quotations, order confirmations, deliveries of parts, engines, equipment, logistics services, storage, and related support. Orders are only binding once accepted in writing by BOND47, and our written confirmation defines the scope, price, and delivery conditions. Any purchase terms issued by the customer apply only if explicitly accepted by us in writing.
Pricing, payment, and taxes
Prices are normally quoted in the currency stated on our offer and are exclusive of VAT, customs duties, and other applicable taxes or charges. Payment terms, including due dates and acceptable payment methods, are specified in the quotation or invoice. In case of late payment, we reserve the right to charge interest, suspend further deliveries, or withhold documentation and certificates until outstanding amounts are settled.
Delivery, risk, and logistics
Delivery dates are target dates and not guarantees unless expressly agreed as binding. Risk in the goods passes to you upon handover to the carrier, freight forwarder, or your representative at the agreed delivery point. You are responsible for any import formalities, duties, and compliance with local regulations, unless otherwise specified in the applicable trade terms (Incoterms) stated in our quotation or order confirmation.
Quality, conformity, and documentation
We supply products in accordance with the specifications, certificates, and regulatory requirements stated in our documentation at the time of delivery. You are responsible for checking goods on receipt and promptly notifying us in writing of any visible damage, discrepancies, or missing documentation within the time period defined in the detailed Terms. Use, installation, and maintenance must follow OEM and regulatory requirements.
Warranty and claims
Warranty coverage, if applicable, is limited to the period and conditions defined in our quotation, certificates, or separate warranty statement. Our liability under warranty is typically restricted to repair, replacement, or credit of the affected item, at our discretion, and excludes wear and tear, improper handling, incorrect installation, or use outside approved conditions. Any claims must be notified within the specified claim period and supported with relevant evidence and documentation.
Returns, cancellations, and special items
Returns and order cancellations are only accepted by prior written agreement and may be subject to restocking or handling fees. Special‑order, customized, life‑limited, or hazardous items may be non‑returnable. The detailed Terms set out the process for return authorizations, packaging, and shipping back items, as well as your responsibilities for risk and costs during return transport.
Limitation of liability
To the maximum extent permitted by applicable law, BOND47’s liability is limited to direct losses resulting from proven breach of contract, up to the invoiced value of the affected order or item. We are not liable for indirect or consequential losses, including loss of profit, loss of use, or loss of business, unless mandatory statutory provisions require otherwise. Nothing in these Terms limits liability for gross negligence, willful misconduct, or any liability that cannot be excluded under applicable law.
Compliance and export control
You agree to use our products and services in compliance with all applicable laws, including export control, sanctions, and safety regulations. Certain products and technical data may be subject to export restrictions or licensing requirements; you must not resell, transfer, or use them in violation of such rules. We reserve the right to refuse or cancel orders where export control, sanctions, or compliance requirements cannot be satisfied.
Data protection and confidentiality
In the course of our relationship, we may process business contact details and other limited personal data for order handling, communication, and compliance purposes, as described in our Privacy Policy. Both parties agree to keep confidential any non‑public commercial, technical, or pricing information received from the other party, except where disclosure is required by law or authorized in writing.
Governing law and disputes
Unless otherwise stated in a specific contract, these Terms are governed by the laws of [insert country / jurisdiction], excluding its conflict of laws rules. Any disputes arising out of or in connection with our business relationship that cannot be resolved amicably will be submitted to the competent courts of [insert city / jurisdiction], or to another dispute resolution forum if agreed in writing.
